Phnom Penh (FN), Oct. 12 –  Dy Vichea, a son of a former police chief Hok Lundy, thanked French Court and Cambodia-France lawyers for their efforts in seeking justice and cleanliness for Cambodian prime minister Hun Sen and himself regarding Sam Rainsy’s public defamation case.

"I, Dy Vichea, a son of the former police chief Hok Lundy, would like to take this opportunity to inform the public that after three years of waiting (since June 2019), I consulted with a lawyer to file a complaint against Sam Rainsy for spreading fake information about the cause of my father’s death,” according to the letter seen by Fresh News on Wednesday (Oct 12).

“Fortunately, on 10 October 2022, the French court rejected Sam Rainsy's statement as there is no clear evidence,” the letter added.

Dy Vichea would like to express his deep gratitude to the French court, in particular Cambodia-France lawyers for their successful mission in bringing justice and cleanliness to him and the premier.

"Of course, my biological father died in a helicopter crash after flying into a bad weather condition, which led to an uncontrollable landing order. As an expert in piloting helicopter, I know about the weather factors and read the expert report of the Air Accident Investigation Team of the State Secretariat of Civil Aviation (SSCA)," the letter continued.

Below are some important points that Dy Vichea quoted from the French court's ruling:

1. Regarding the evidences provided by Sam Rainsy, the court considered that they did not contain specific elements demonstrating that the cause of the accident was an explosion.

2. The accusation that premier Hun Sen was the mastermind behind the assassination of the two political cases and that he concealed the circumstances of the assassination is damaging the honor and reputation of the plaintiffs (the premier). Therefore, this accusation must be considered as a defamation of Hun Sen.

3. Under these conditions, the criminal trial may significantly affect the disproportionate level of freedom of expression between the plaintiff and the defendant, which is protected by Article 10 of the European Convention on Human Rights, so that Sam Rainsy will receive the acquittal of both charges.

4. He [Sam Rainsy] never knew Dy Vichea, but he wanted to seek justice on behalf of Dy Vichea.

The letter added, "since I grew up, I know that my father went to war with the premier to free the nation and the people from the Khmer Rouge regime. My father gained trust and position from his sacrifice with Samdech. Both families are so close. In fact, in 2002, my younger sister married the third son of premier, Hun Manit, and I married Hun Mana, the second daughter of Samdech in the late 2009. We both have children. Is it possible that my father's death was like what Sam Rainsy said? Can a normal person think like this? Sam Rainsy, it is time to be a mindful person."
