Phnom Penh (FN), Dec. 20 – Cambodian authority enforced the Phnom Penh Municipal Court’s order to examine the current status of the real estate belonged to former leader of the court-dissolved Cambodia National Rescue Party (CNRP) Sam Rainsy, located in Chak Angre Leu commune.

On 4 November 2021, the court has decided to forcibly sell the house owned by former leader of the court-dissolved Cambodia National Rescue Party (CNRP) Sam Rainsy to cover for legal compensation.

The decision was made after the request for the direct enforcement of the four civil parties and the other four cases of the Phnom Penh Prosecution. The requests came after the losing party did not fulfill his obligations to pay compensation in accordance with the final verdict issued three years ago and other subsequent verdicts.

The Civil Parties include Cambodian prime minister Hun Sen, president of the National Assembly Heng Samrin, minister of Interior Sar Kheng, and a lawyer representing the Royal Government of Cambodia.

In the defamation case filed by premier Hun Sen's lawyer, the court ordered convict Rainsy to pay 4 billion riels in compensation. The final verdict in this case was issued by the Supreme Court on 19 December 2018.

In the case filed by the lawyer representing National Assembly president Heng Samrin, the court ordered Rainsy to pay 4 billion riels in compensation. The final verdict in this case was issued by the Supreme Court on 1 November 2017.

In addition, in the case filed by the lawyer representing minister Sar Kheng, the court ordered Rainsy to pay 2 billion riels in compensation. The verdict was issued by the Phnom Penh Municipal Court on 30 December 2020.

In a separate case filed by a lawyer representing the Royal Government of Cambodia, the court ordered Rainsy to pay 1.8 billion riels in compensation. The verdict in this case was issued by the Phnom Penh Municipal Court on 1 March 2021.

The “sale by force” is in compliances with article 350 of the civil code.

According to the decision, the court will do as follow:

1. Implement the forced sales procedure.

2. Confiscate the immovable property with the land title No. 09725 dated 15 August 2007 issued by the Department of Land Management, Urban Planning, Construction, located in Sangkat Chak Angre Leu, Khan Meanchey, Phnom Penh, which belongs to the debtor Sam Rainsy and his wife Tioulong Saumura to cover the legal compensation.
